By accessing or using the Surf Tulsa application and website ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
Surf Tulsa provides information about inland surf spots, wave pools, and river surfing locations worldwide. The Service displays live river flow data, water temperatures, weather conditions, and spot information to help users plan surfing sessions.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee the accuracy, completeness, or timeliness of any data displayed in the app, including but not limited to:
River surfing, wave pool surfing, and all water activities involve inherent risks including but not limited to drowning, injury, and exposure to waterborne hazards. By using this Service, you acknowledge and accept that:
To the maximum extent permitted by law, Tulsa Surf Club, its operators, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
The Service includes data sourced from third parties (USGS, Open-Meteo, OpenFreeMap, OpenStreetMap) and links to external websites. We are not responsible for the content, accuracy, or practices of any third-party sites or services.
The Surf Tulsa name, logo, design, and original content are the property of Tulsa Surf Club. You may not reproduce, distribute, or create derivative works without our written permission.
We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Your continued use of the Service after any changes constitutes acceptance of the new terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to conflict of law principles.
Locals is a community listing and scheduling feature. Tulsa Surf Club does not provide, supervise, direct, recommend, endorse, certify, or control surf seshes. Listed surfers are independent third parties, not employees, agents, or representatives of Tulsa Surf Club. Their profiles are self-described. We do not conduct background checks or verify their identity, skill, training, certification, experience, insurance, equipment, or safety practices. A listing is not an endorsement.
Any surf sesh, advice, instruction, equipment, transportation, communication, payment, refund, or dispute is solely between you and the listed surfer. Tulsa Surf Club is not a party to that arrangement and does not collect, process, hold, or refund payment. You are solely responsible for deciding whether another person, their experience, and any equipment or activity are suitable for you.
Listed surfers are responsible for keeping their profile, availability, prices, payment information, and statements about their own experience accurate. They may not claim training, certification, insurance, or qualifications they do not have.
River surfing, whitewater recreation, receiving advice or equipment from another person, and being near moving water involve known, unknown, and inherent risks. These include changing currents, submerged structures, collision, entrapment, equipment failure, exposure, illness, drowning, serious injury, death, property loss, and the acts, omissions, or negligence of you, a listed surfer, or other people. By requesting or participating in a surf sesh, you knowingly and voluntarily accept and assume all such risks.
To the fullest extent permitted by Oklahoma law, you release, waive, discharge, and covenant not to sue Tulsa Surf Club, Surf Tulsa, and their owners, officers, members, employees, agents, affiliates, and volunteers (the "Released Parties") for claims, demands, damages, losses, costs, or causes of action arising from or related to your use of Locals, your selection of or communications with a listed surfer, payment, travel, presence at the Tulsa Wave, or participation in a surf sesh, including claims alleging ordinary negligence by a Released Party. This release does not apply to liability that cannot lawfully be waived, including liability for gross negligence, reckless or willful misconduct, fraud, or violation of law.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold the Released Parties harmless from third-party claims arising from your conduct, your breach of these Terms, or a booking you make for another person. If any portion of this section is found unenforceable, the remaining provisions will continue to the fullest extent permitted by law.
The person making a booking confirms they are at least 18 years old. A minor may participate only with a parent or legal guardian and any separate consent required by law or the park. You are responsible for checking conditions, asking the listed surfer questions, using appropriate equipment and a properly fitted personal flotation device, staying within your abilities, and following posted instructions.
A listed surfer may cancel a paid reservation if payment is not received within 24 hours of booking, or before the surf sesh when booked on shorter notice. Listed surfers are responsible for their prices, payment accounts, taxes, refunds, and payment disputes. You may cancel online from the private booking link before the surf sesh begins. Any payment or refund remains solely between the booking parties.
You are responsible for evaluating conditions, using appropriate safety equipment, following posted instructions, and complying with the Tulsa Wave Park rules and safety guidelines. Tulsa Surf Club does not own or operate the park, control its conditions, or provide lifeguards or water-safety patrols.
